How North Carolina HOAs Are Governed

Most North Carolina planned communities are governed by the North Carolina Planned Community Act (N.C. General Statutes Chapter 47F), which covers assessments, meetings, records, and enforcement for communities created after January 1, 1999 (with some provisions applying to older communities). Condominiums are governed separately by the North Carolina Condominium Act (Chapter 47C). Because most associations are incorporated as nonprofit corporations, the North Carolina Nonprofit Corporation Act (Chapter 55A) also applies to how the association operates, holds meetings, elects directors, and keeps records.


An association's own governing documents — the declaration of covenants, conditions, and restrictions (CCRs), the bylaws, the articles of incorporation, and any recorded plat — work together with these statutes and generally control day-to-day matters as long as they do not conflict with state law. Additional North Carolina statutes address specific issues such as transfer fees (Chapter 39A) and solar devices (Chapter 22B-20). Federal laws, including the Fair Housing Act, the Americans with Disabilities Act, and the Fair Debt Collection Practices Act, also apply.


North Carolina does not have a state agency that oversees HOAs, and community managers are not required to hold a state HOA-management license. That makes experienced, responsive management especially important, and it is where The HOA Managers helps — pairing a local community manager with our central administrative team.
